These Terms of Service ("Terms") govern your access to and use of iakoob at iakoob.online (the "Platform"), operated by Kshathra Technologies Inc. ("we", "us", or "our"). By creating an account or using the Platform, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the Platform. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly permit individuals under 13 to create accounts.

2. Account Creation

To access most features, you must create an account. You agree to:

Provide accurate and complete information when registering.
Keep your password confidential and not share it with others.
Notify us immediately at support@iakoob.online if you believe your account has been compromised.
Be responsible for all activity that occurs under your account.

You may not create accounts on behalf of another person without their consent, or create multiple accounts to circumvent a suspension or ban.

3. Content Ownership and License

You own your content. Any original writing, artwork, audio, or other creative work you upload or create on the Platform remains your intellectual property.

By posting content to the Platform, you grant Kshathra Technologies Inc. a non-exclusive, worldwide, royalty-free license to host, store, display, transmit, and process your content solely for the purpose of operating and providing the Platform. This license ends when you delete your content or account, subject to reasonable caching or backup retention periods.

You represent and warrant that you have all necessary rights to the content you post, and that your content does not infringe the intellectual property rights of any third party.

4. Prohibited Content and Conduct

You may not use the Platform to post, create, transmit, or facilitate:

Content that infringes any copyright, trademark, or other intellectual property right.
Content that constitutes harassment, targeted abuse, threats, or incitement to violence against any person or group.
Illegal content of any kind, including content that violates applicable law in Canada, the United States, or your local jurisdiction.
Child sexual abuse material (CSAM) or any content that sexualizes minors. Violations will be reported to relevant authorities immediately and without notice.
Hate speech, including content that promotes discrimination or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
Spam, unsolicited commercial messages, or coordinated inauthentic behavior.
Malware, phishing content, or any code intended to harm users or systems.
Impersonation of another person, creator, or entity in a misleading way.

5. AI Features

The Platform includes AI-assisted tools for writing, translation, and creative production. These features are powered by third-party AI models (including services provided by Microsoft Azure). You acknowledge and agree that:

AI-generated content may contain errors, inaccuracies, or unexpected outputs.
You are solely responsible for reviewing, editing, and taking responsibility for any content you publish, regardless of how it was created.
You may not use AI features to generate content that violates these Terms or our Acceptable Use Policy.
We make no warranty as to the accuracy, quality, or fitness for purpose of AI-generated outputs.

6. Payments and Subscriptions

Certain features of the Platform are available through paid subscriptions or one-time purchases. All payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service.

Subscription fees are billed in advance on a recurring basis. You may cancel at any time through your account settings.
Cancellations take effect at the end of the current billing period. No partial refunds are issued for unused time in a billing period unless required by applicable law.
We reserve the right to change pricing with reasonable notice. Continued use after a price change constitutes acceptance.
Digital content purchases (e.g., individual books or chapters) are generally non-refundable once accessed, except as required by law.

7. Termination

We may suspend or terminate your account at our discretion if we determine you have violated these Terms or our Acceptable Use Policy. We will generally provide notice and an opportunity to appeal, except in cases of serious violations (such as CSAM or illegal content) where immediate action is required.

You may delete your account at any time through your account settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

8. Disclaimers

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kshathra Technologies Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform — including loss of data, loss of profits, or loss of content — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim or (b) $100 CAD.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform or by email. If you continue to use the Platform after the effective date of any change, you are agreeing to the updated Terms.
